About these terms

Zivanor Gifts is provided by VisionHost International B.V., Den Haag, The Netherlands ("we", "us"). By using the app or gifts.zivanor.com you agree to these terms and to the general Zivanor Terms of Use. Where the two differ, this page applies to Zivanor Gifts. How we handle data is described in the Zivanor Gifts privacy policy.

The service

The app lets a group draw names, share wishlists and gift lists, pick a date, answer an invitation, share a bring list and keep a circle of birthdays, and lets you keep a private birthday calendar with reminders on your phone. No account is needed for any of it. It is free of charge; the current version contains no ads and no in-app purchases. We may change, limit or stop the service; if we stop it, existing groups remain available until their normal deletion date where that is reasonably possible.

Links and personal keys

You do not need an account. Your place in a group is a personal key on your phone, or a personal link. You may sign in with an e-mail address and a one-time code to keep your places on another device; that is optional and you can delete it in the app at any time. Whoever has the link can act as you in that group, so keep it to yourself. If you lose it, an organiser of the group can give you a new one, or you get it back by signing in with the e-mail address you kept your lists with. Without that sign-in we cannot identify you and therefore cannot restore access ourselves.

The join link lets anyone who has it see the group's name and the names in it, and join. Share it only with the people you want in the group.

What you type

You are responsible for the names, wishes, questions and links you add. Do not add anything unlawful, threatening, hateful or sexual, anything that infringes someone else's rights, or sensitive personal information about yourself or others. Do not harass, bully or threaten anyone, also not through an anonymous question. Do not add other people to a group against their wishes. We may remove a group or an entry that breaks these rules, and we may block addresses that misuse the service.

Zero tolerance for objectionable content and abuse

There is no tolerance for objectionable content or abusive users. Everybody in a group can report an anonymous question they received, a person in the group or the group itself (in the group: More → Report a problem). Whoever receives an anonymous question can block the person who asked it: that person's questions disappear and they cannot ask again. A report reaches us with a copy of the reported content, and we review every report within 24 hours. We remove content that breaks these terms, and we may remove the user who posted it from the group or delete the whole group. You can also write to support@zivanor.com. Until the names are drawn you can leave a group yourself, and organisers can remove people and delete the group.

Organisers

An organiser can change the group's details, add and remove people, set who must not draw whom, start and undo the draw, issue new personal links and delete the group. Organisers are responsible for how they use these tools and for telling people they add on their behalf.

The draw

The draw is made by our server at random within the rules the organiser set. We do our best to keep the result secret from everyone but the person concerned, but we do not guarantee a surprise: people can tell each other, and anyone holding another person's personal link can see what that person sees.

Ads and Zivanor Pro

The current version of the app shows no ads, and the paid upgrade Zivanor Pro is not available in it: there is nothing to buy in the app. If a later version adds ads or Zivanor Pro, we will update these terms before that version is released, and the price and conditions will be shown in the app before you buy.

Shop links and gift ideas

Links to shops are offered for convenience. Links marked with * are affiliate links: the shop may pay us a commission when you buy, at no extra cost to you. As an Amazon Associate we earn from qualifying purchases. A purchase is an agreement between you and the shop. Prices, pictures and availability shown in the app are indications and can be out of date; the shop's own page decides. We are not responsible for the shops, their products or their delivery.

Deletion

A group and everything in it is deleted automatically 60 days after the date of the party (a group without a date: 18 months after it was last used), and sooner when an organiser deletes it. You can delete the optional account at any time (how). Deleted data cannot be brought back. Keep your own copy of anything you want to keep.

No warranty and liability

The app is provided as it is, without a guarantee that it is always available or free of errors. To the extent the law allows, we are not liable for loss arising from the use of the app, from unavailability, from a lost link, from what other people in a group type or do, or from purchases at shops. Nothing in these terms limits rights you have as a consumer under the law of your country, or our liability for intent or gross negligence.

Law

Dutch law applies. Disputes are put before the competent court in The Hague, unless mandatory consumer law gives you the right to a court in your own country.
